1. Acceptance of Terms
By accessing or using the Delivery Data platform and services ("Services"), you agree to be bound by these Terms of Service. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Services
Delivery Data provides a cloud-based logistics intelligence platform that offers real-time tracking, predictive analytics, route optimization, fleet management, and data integration services. The specific features available to you depend on your subscription plan.
3. Account Registration
To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Infringe on any third party's intellectual property rights
- Transmit malicious code, viruses, or any destructive content
- Attempt to gain unauthorized access to any systems or networks
- Interfere with or disrupt the integrity of the Services
- Use the platform for competitive analysis or benchmarking
5. Data Ownership
You retain all rights to the data you upload to our platform. We do not claim ownership over your logistics data, tracking information, or any other content you provide. We process your data solely to deliver the Services as described in your subscription agreement.
6. Payment Terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change our pricing with 30 days' advance notice. If you do not agree to a price change, you may cancel your subscription before it takes effect.
7. Service Level Agreement
We commit to 99.9% uptime for our core platform services, measured on a monthly basis. If we fail to meet this commitment, Enterprise customers may be eligible for service credits as detailed in their individual service agreements.
8. Limitation of Liability
To the maximum extent permitted by law, Delivery Data shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Services.
9. Termination
Either party may terminate the agreement at any time. Upon termination, your right to access the Services will cease immediately. We will make your data available for export for 30 days following termination, after which it may be permanently deleted.
